Texas AG sues Delaware abortionist for mailing abortion pills into state

Texas Attorney General Ken Paxton has announced that his office has sued Debra Lynch, a Delaware abortionist responsible for sending abortion pills into the state of Texas, where the law protects nearly all preborn children from abortion.

The Details:

The lawsuit, filed January 27, states that Lynch is a nurse practitioner from Delaware who operates the "extremist" group Her Safe Harbor, an organization that mails abortion pills to all 50 states, including those with preborn protections like Texas. It comes on the heels of a "cease and desist" Paxton sent to Lynch in August 2025.

As a press release indicates: "This lawsuit follows two tragic cases in Texas in which radical abortion activists and organizations facilitated men illegally purchasing abortion-inducing drugs. According to one lawsuit, a man used the drugs to secretly poison his girlfriend, causing the death of their unborn child, and sending the mother to the hospital." 

“The day of reckoning for this radical out-of-state abortion drug trafficker is here,” Paxton said. “No one, regardless of where they live, will be freely allowed to aid in the murder of unborn children in Texas.”

Paxton previously sent cease and desist letters to Plan C and California abortionist Remy Coeytaux, also warning them to stop shipping the abortion pill into the state.

However, "shield laws" in pro-abortion states specifically protect abortionists from penalty when they send abortion pills into states where it is illegal.

Paxton's lawsuit references a quote from Lynch, it which she allegedly claimed that Her Safe Harbor will “mail a lot [of abortion drugs] to Texas,” to locations including Beaumont, Fulshear, Tomball, Houston, El Paso, and other major cities.

A January 2025 article in the Austin American Statesman featured Lynch and showcased her and her husband, Jay, shipping the abortion pills from their Delaware home.

“We’re mailing a lot to Texas,” Jay Lynch said.

“Everybody – Aid Access, ourselves, some of these other small groups – we are all shipping to Texas,” Debra Lynch added.

Elsewhere in the article, she said she was undeterred by any threat of legal action from Paxton.

“I don't fear Ken Paxton,” she said. “I don't fear getting arrested or anything like that.”

The Bottom Line:

The protection of preborn children and their mothers from the abortion pill should not be dependent upon location. The abortion pill is deadly for preborn children, and risky for their mothers.

All humans have a right to be protected from a poison that could kill or injure them.
