Spain moves to make abortion a constitutional 'right'

Legislators in Spain are seeking to make abortion a constitutional "right," continuing the country's descent into pro-abortion extremism.

Key Takeaways:

  • Spain originally legalized abortion in 1985, though it was only permitted in cases of rape, fetal disability/abnormality, or to save the life of the mother.

  • In 2010, legislators allowed abortion to be permitted for any reason through 14 weeks of pregnancy.

  • Women can undergo abortions after 14 weeks if a doctor claims it is necessary to preserve her health — including her mental health.

  • Minors can undergo abortions without their parents' knowledge or consent.

  • Spanish legislators are now looking to enshrine abortion as a 'right' in the country's constitution.

The Details:

Prime Minister Pedro Sánchez’s Socialist Party is looking to make abortion a constitutional right in response to efforts from the Madrid city council to give abortion-seeking women information about the potential psychological effects of abortion.

On X, Sánchez wrote:

The PP has decided to merge with the far right. That's their choice. They can do it. But not at the expense of women's freedoms and rights. For that reason, we are going to:

1️⃣ Prevent the provision of misleading or anti-scientific information about abortion, by reforming Royal Decree 825/2010 and

2️⃣ Bring to Parliament a proposal to constitutionalize the right to voluntary termination of pregnancy, in line with the jurisprudence of the Constitutional Court.

With this Government, on social rights, not one step back.

Not everyone agrees with this move; though People's Party (PP) leader Alberto Núñez Feijóo has said though he does agree with keeping abortion legal, he does not agree that it comprises a fundamental human right.

If Spain decides to make abortion a constitutional right, it will be only the second country in the world to do so, following France in 2024 (which was in direct response to the overturning of Roe v. Wade in 2022 in the U.S.).

The Backstory:

Spain has become increasingly hostile to pro-lifers, though thousands continue to publicly march for life. Testimonies at the march have included those fighting against the legality of eugenic abortions, saying that people with disabilities have the right to exist. “He’s like a 6-month-old child,” Paloma Zafrilla said of her 26-year-old brother, adding, “A life is never less of a life according to what your abilities are… we are not machines and our value is not based on what we produce.”

Yet pro-abortion activists have been aggressively fighting against the pro-life movement, even threatening and harassing parishioners of a Catholic church before vandalizing it with pro-abortion messaging and imagery.

Pro-lifers have also been arrested merely for praying outside abortion facilities after politicians voted to criminalize so-called "harassment" of women entering the facilities. People attempting to participate in 40 Days for Life campaigns have likewise faced harassment and intimidation from private citizens, as well as arrests from local authorities, merely for being publicly pro-life.

The Bottom Line:

Spain is already well on the road towards fully embracing the culture of death, and making abortion a constitutional "right" is just the next stop. The truth is, there is no such thing as a 'human right' which involves depriving others of their human rights — particularly the most sacred right of all: the right to life.
