If Clara had been properly advised that abortion would terminate her relationship with her child by terminating the life of a whole, separate, unique, living human being, she would not have submitted to the abortion. Clara did not know that an abortion killed an existing human being. If she was told that the killing of a child in utero was a murder punishable by life imprisonment, she never would have signed a “consent” for an abortion.

If Clara had been properly advised that the abortion doctors and nurses would be immunized from prosecution under the Minnesota murder statute solely because PPMNS/PPNCS secured her signature on a “consent” form, she would not have submitted to the abortion. Clara’s waiver of her rights and “consent” to the abortion was not knowing and informed, and were not voluntary in the true sense.

Clara’s abortion, which she did not want and which wrongfully deprived her of her 14th Amendment rights and interests, has caused her to suffer extreme mental and emotional anguish, including extreme shame and sadness, depression, anger, remorse, and daily psychological rumination over the loss of her baby.

The father of KPS’s child also demanded she have an abortion. He refused to take any responsibility for the child or provide any financial or emotional support to KPS.

KPS’s mother and the baby’s father continued to pressure her to abort. Despite the pressure being exerted upon her and the stress caused by the prospect of raising her child without any support, KPS was determined to take care of her baby on her own.

Over time, however, KPS was overwhelmed by the mounting pressure, stress of her circumstances, and lack of support, so she telephoned PPMNS/PPNCS’s St. Paul facility, which scheduled an abortion.

When KPS arrived at PPMNS/PPNCS’s St. Paul facility on the day of her scheduled appointment, she could feel her baby kicking. She began to cry and sob. PPMNS/PPNCS workers saw KPS’s distress but did nothing to help her. She fled the facility without submitting to the abortion.

KPS’s deep reluctance to have an abortion and her natural instinct to nurture and protect her baby resulted in a cycle of scheduling three additional appointments which she decided not to attend, and effectively cancelled. KPS wanted to keep her child but felt pressured to submit to the abortion. She was so conflicted and ambivalent that she scheduled and intentionally missed three subsequent abortion appointments.

There was no discussion about the script. The worker didn’t answer any of KPS’s questions, except one. KPS asked if her baby would feel pain in the abortion. The worker lied and told KPS that what was being removed was “nothing but tissue.”

When KPS arrived at PPMNS/PPNCS’s St. Paul abortion facility for her fifth scheduled appointment, PPMNS/PPNCS required her to sign the “consent” while she was in the waiting room, before speaking with a doctor, nurse, or “counselor.” PPMNS/PPNCS did not engage in any informed consent process. KPS was crying when she was taken into the procedure room. Nobody from PPMNS/PPNCS asked her why she was so distressed. Instead, she was given medication that knocked her out.

When KPS regained full consciousness after the abortion, she asked to see her baby. PPMNS/PPNCS presented KPS with her child’s dismembered remains in a metal pan. KPS saw her dismembered baby’s head and other body parts. She could not stop crying.

Before she left the PPMNS/PPNCS facility, KPS requested her baby’s remains for proper burial. She was advised the remains could be released only after she paid a funeral parlor. Within several days, KPS paid the money and her baby’s remains were released to her. KPS had her baby buried.

“The next moment, I felt a gas mask going over my face. I remember struggling as I understood what was happening to me. I awoke a few minutes later, and my first thought was, ‘I hope they didn’t kill my baby.’ I cried out and asked if they had done the abortion, and of course they had. My grief was overwhelming. So was my shock, anger, and betrayal.” 

“I tried to close my legs, but they were spread against my will. They said I was fine and continued the vacuum tube was put in my vagina and the vacuum turned on. I said I wanted to run away and save the life of my baby. They ignored me, I was semi sedated."

I asked them to please unstrap me and let me leave. The anesthesia was administered, and I fell asleep to the sound of their laughter. When I woke up, I was hurting physically as well as emotionally. All around me were the sounds of other women sobbing.”

“The counselor left hurriedly down the hall and I followed to see exactly what was going on and what I saw in the hall was the counselor, a 17-year-old girl and her aunt, dragging her into the room as she was hollering, ‘No, I don’t want to go! Please don’t make me! Please don’t make me do this! I really don’t want to do this!’

They very hurriedly shoved her in the room where the procedure was to take place and slammed the door and the counselor came out afterwards with a sort of a peaceful smiling look on his face, and I knew what had happened. I knew that they had aborted her against her will.”

During the ultrasound, I heard my baby’s heartbeat loud and clear. Halfway through my ultrasound I stood up and ran out of the room and found myself up against a door. That is the last thing I remember aside from waking up in the recovery room.

I imagine that I was drugged to keep quiet. The staff at Planned Parenthood were concerned that I would scare the other women there preparing for their abortions.”
