LIFE ON THE BALLOT: Midterm Election 2026 Results
11/3/26, 8:08p EST: NBC News projects that Virginia ballot Question 1: Right to abortion will pass, cementing abortion as a "right" in the state of Virginia.
Several abortion-related amendments were on the ballot on Tuesday, and key national races could set the stage for establishing a nationwide statutory right to abortion.
Pro-abortion gains in the House and the Senate could ultimately undo pro-life gains since the fall of Roe v. Wade.
If pro-abortion legislators take control of either or both the Senate and the House they plan establish federal rules that would restrict states' ability to protect preborn children.
If passed, Idaho's Proposition 1 would end protections for preborn children.
If approved, Missouri's Amendment 3 seeks to protect most preborn children from abortion and ensure parental consent for minors.
If Nevada's Question 6 is approved, it would be a step toward making abortion a fundamental constitutional right until fetal "viability." A second vote would secure this.
If Virginia's Right to Reproductive Freedom amendment is approved, it would cement abortion as a state 'right'.
For pro-life Americans and the preborn babies they seek to protect, the 2026 elections had serious implications.
Since the overturning of Roe v. Wade in 2022, pro-life states have successfully passed pro-life legislation to protect preborn children. However, as Live Action News previously reported, pro-abortion legislators plan to establish federal rules that would restrict states' ability to protect preborn children. This means it matters deeply whether pro-abortion legislators win.
As previously reported by Live Action News,
If enacted, the Women’s Health Protection Act would substantially alter the balance between federal authority and state law.
The EACH Act would similarly change federal policy by expanding government financing of abortions.
For states that have spent the past four years strengthening their abortion laws, these proposals represent a potential reversal of significant legislative work. The legal questions would also extend beyond the initial passage of either bill. Federal courts could be asked to determine the scope of congressional authority and the relationship between the new legislation and existing state restrictions.
The result would be another major chapter in the national legal battle over abortion.
A four-seat gain by pro-abortion Democrats in the Senate would give them control, and therefore put preborn lives at risk. The states to watch are Alaska, Maine (though Republican Susan Collins has consistently voted pro-abortion), Texas, Michigan, Iowa, Kansas, and Ohio.
Pro-abortion Democrats could also take control of the House, which is currently Republican led 218-214.
Idaho: Idaho's Proposition 1 would end protections for preborn children, making abortion a right and restricting the state's ability to protect babies and enact regulations.
Missouri: Missouri's Amendment 3 seeks to protect most preborn children from abortion and ensure parental consent for minors.
Nevada: In Nevada, if voters approve Question 6 the state would be one step closer to making abortion a fundamental constitutional right until fetal "viability" as determined by the abortionist. It would also allow abortion after "viability" to protect the mother's life or broad, undefined "health"; and would disallow any governmental intervention against that so-called "right." If passed, the state legislature would not be able to enact new protections for preborn children, and existing safeguards would likely be challenged. A second and final vote would be required if it passes.
Virginia: In Virginia, voters are being asked to write abortion into the Bill of Rights of their state constitution, cementing abortion as a "right" in the state.
