Israeli court upholds requirement that sperm donors remain anonymous
An Israeli court last week declined to overturn the country's rule that sperm contributors must remain anonymous.
Israel's High Court has declined a petition seeking to overturn the country's requirements that sperm donors remain anonymous.
The petition was filed five years ago by the organizations Choosing Family and B’Tzalmo, which argued that anonymous donation violates the rights of children to know their biological parents.
Anonymous sperm contribution disregards the rights of the child, who deserves to know where they come from.
Five years ago, the organizations Choosing Family and B’Tzalmo had filed a petition with Israel's High Court seeking to overturn the country's requirements that men who sell their sperm to create children for other people remain anonymous.
According to The Jerusalem Post, "The petitioners argued that the provision guaranteeing donor anonymity violates children’s right to know who their biological parents are."
Last week, Israel's High Court declined the petition, keeping in place the requirement that all sperm contributors will remain anonymous. Each donor signs a form confirming their anonymity, and the woman purchasing the sperm receives no identifying information.
Allowing a sperm contributor to remain anonymous deprives the child of their right to know where they come from, who they are, and what their identity is. Without this knowledge, they have no way to know their biological father or their medical histories, ancestry, heritage, and background.
As one donor-conceived adult previously told France24:
“It presents a constant question mark in my mind, one that’s been there since my conception. I know the sperm donor is part of me, but I don’t know what he passed on. The little game everyone plays with their parents is to know, hey, I take after dad in this way. The question remains unanswered for me. My father was able to transmit through his presence through nurture, but in regard to nature, what did my donor transmit?”
Anonymous sperm contribution also prevents the child from finding their biological siblings. There have been numerous donors who have been found to have conceived hundreds of children — some even potentially having fathered thousands. This has led to cases of siblings living in the same town, attending the same school, and even dating, without the knowledge that they were biologically related.
Like so many aspects of assisted reproductive technologies, anonymous sperm contribution thinks only of the adults involved — in this case, of men who want no ties to their biological children. It's time to start considering children instead.
