Fifth Circuit Decision Halting Mail-Order Abortion Pill Major Step Forward
Lila Rose Calls for Nationwide Ban on Abortion Pill

Washington, D.C. – Today, Live Action, one of the nation’s leading human rights organizations, commends the United States Court of Appeals for the Fifth Circuit’s decision halting the reckless expansion of mail-order abortion pills and calls for the Trump Administration to pull the abortion pill from the market completely.

Live Action Founder and President, Lila Rose, released the following comment:

“Today’s decision from the United States Court of Appeals for the Fifth Circuit is a major step toward justice. The court halted the reckless mail order abortion pill scheme that has fueled a surge in chemical abortions, now used in the majority of abortions nationwide. These drugs are designed to end the life of a preborn child, and they are now responsible for the destruction of millions of preborn lives, often behind closed doors with no doctor present. Most recent data also shows nearly 11 percent of women who take the pill suffer serious adverse effects, with complications including severe bleeding, infection, and emergency medical care.

The court also recognized the injury to Louisiana’s “sovereign prerogative of protecting unborn life.” This must be the turning point. We are calling on Health and Human Services Secretary Robert F. Kennedy Jr. and President Donald Trump to act immediately to take this dangerous drug off the market once and for all with a full and permanent ban.”

The Fifth Circuit's stay affirms that federal agencies cannot bypass basic safety protocols to expand access to high-risk drugs. By rejecting mail-order distribution of abortion pills, the court reinforced that in-person physician involvement remains a necessary safeguard under the law.

Chemical abortions, primarily using the drug mifepristone in combination with misoprostol, account for 65% of all abortions in the U.S. and have increased dramatically due to Biden-era FDA policies that removed critical requirements, such as in-person dispensing and restrictions on mail distribution. These changes have enabled abortions without physician supervision, heightening risks to women and ending the lives of  7.5 million preborn children and at least 36 women.

Live Action continues to document the unacceptable state of chemical abortions and urges for HHS and the FDA to ban the abortion pill by pulling it from the market completely.
