Nearly two dozen couples sue fertility clinic for destroyed embryos
A lawsuit involving 23 couples has been filed against a California fertility clinic, where a laboratory error led to the destruction of countless human embryos.
In January of 2024, Ovation Fertility allegedly suffered an error during the pre-implantation thawing process.
Many allege that, rather than telling the would-be parents what had happened, the clinic implanted the dead embryos despite knowing they were not viable.
A lawsuit was filed on behalf of nine couples in April of 2024; that number has now grown to 23.
Between January 18 and January 30 of 2024, Ovation Fertility in Orange County, California, began the process of thawing embryos to prepare for implantation. Yet it went catastrophically wrong; the affected couples claim that a laboratory employee used hydrogen peroxide or another cleaning solution on equipment connected to an embryo incubator, which allowed it to seep into the environment where embryos were stored and prepared for transfer.
The couples affected say Ovation did not inform them of the error, but implanted the embryos as if nothing was wrong. However, there was allegedly a 0% success rate for that group of patients, when lawyers claim it should have been closer to 75%.
"These embryos, which are dead, were implanted into these hopeful mothers without their knowledge," Rob Marcereau, an attorney representing the plaintiffs, told USA Today. "They had to undergo this invasive implantation process hoping to become pregnant and never had a chance."
A whistleblower said this was not a one-time issue, but systemic, according to Marcereau, with numerous instances of laboratory failures leading to destroyed embryos.

Originally, nine couples were named in the lawsuit against Ovation. Now, it has risen to 23. The clinic is being accused of negligence, medical battery, concealment, and negligent hiring and supervision. But the issue is calling into question a bigger problem.
"Hair salons have more regulation than fertility medicine," Marcereau said. "There needs to be legislation (and) regulations so that these kind of things don't continue to happen. There needs to be regulation about the qualifications of people who can operate and work in labs. There needs to be regulations regarding protocols for the storage and throwing of embryos."
There have been numerous such instances in the fertility industry, including one affecting 700 patients and resulting in a $56 million settlement. Yet the industry remains shockingly underregulated, allowing such incidents to continue. It further reiterates the anti-life nature of in vitro fertilization (IVF), which now causes the destruction of more lives than abortion.
Embryos are not just meaningless blobs, but actual human beings. Yet all too often, these embryos are graded, labeled, and destroyed, both intentionally and accidentally, in an industry which purports to create life.
