Live Action Condemns Senate Democrats Failure to Pass the Born-Alive Abortion Survivors Protection Act

“A new Marist poll shows 80% of Americans want to limit abortion after the first three months of pregnancy, but Democrats can’t even find consensus on limiting abortion after a child is born.”

Washington, D.C. (Feb. 25, 2019) – Today, the United States Senate voted on “The Born-Alive Abortion Survivors Protection Act”, legislation requiring medical professionals to provide care to newborn babies who survive an attempted abortion. The final vote was 53-44. The Born-Alive Abortion Survivors Protection Act, introduced by Sen. Ben Sasse (R-NE.), declares that “If an abortion results in the live birth of an infant, the infant is a legal person for all purposes under the laws of the United States, and entitled to all the protections of such laws. Though President Bush signed the Born Alive Infants Protection Act into law in 2002 (which passed Congress by unanimous consent), it only established that the terms “person”, “human being,” “child”, and “individual” in federal law include every infant born alive, even after abortion. It instituted no penalties for physicians who neglected to care for such infants. Sen.   Sasse’s Born-Alive Infants Protection Act would have, according to its text:

• Created criminal penalties for doctors who allow infants to die rather than providing medical care after attempted abortions

• Mandated that a child born alive in an abortion clinic be transported to a hospital for further care

• Required health practitioners to report any violations of the law

• Instituted penalties for intentionally killing a newborn, including fines and up to five years’ imprisonment

• Granted the woman on whom the abortion is performed civil cause of action against the abortionist and protection from prosecution if her child is not cared for after birth

According to the Centers for Disease Control (CDC), nationwide, between 2003 and 2014 at least 143 babies died after being born alive during botched abortions – and the CDC states this could be an underestimation. In 2018, 16 infants in Florida alone were born alive after surviving abortion attempts. Senators who voted no on the Born Alive Abortion Survivors Protection Act should be ashamed of themselves. Shockingly, infanticide in the context of abortion is not illegal in the U.S. There is no existing federal law that prohibits the denial of medical care to infants born alive after abortion attempts. The Born-Alive Abortion Survivors Protection Act would have appropriately required that infants delivered alive during attempted abortion procedures be given appropriate medical care and penalized those who neglected to save them.”

“Live Action has documented on camera how abortionists in our country’s notorious late-term abortion facilities talk about survivors of abortion. Washington, D.C. abortionist Cesare Santangelo told our undercover investigators that he would make sure babies “do not survive” if they were born alive at his facility. A New York abortion worker told our Live Action investigator to “flush” the baby down the toilet or “put it in a bag” if she’s born alive. In Arizona, an abortion worker told us there “may be movement” after the baby is outside of the mother and that they would refuse to provide help and instead let her die. Dr. DeShawn Taylor, former medical director for Planned Parenthood, told a Center for Medical Progress investigator that identifying “signs of life” after a baby survives an abortion is contingent upon “who’s in the room.”

“There is no difference between infanticide and abortion: both kill the same child. We as a society have all of the information we need: undercover investigations, survivor testimonials from women like Gianna Jessen and Melissa Ohden who survived abortions, abortion workers on the record discussing their inhumane treatment of survivors, and Center for Disease Control data showing that babies are surviving abortions. Today should have been a time of unity in protecting life, but instead, Democrats continue to push for the brutality of abortion and infanticide. With Congress failing to do its job, every state should take this issue up for themselves, ensuring care for these innocent children that are often left to die, and work to eradicate abortion altogether.”
