Courts in Germany and Austria rule against buffer zone laws
Europe’s pro-life advocates have won key legal triumphs in Germany and Austria, as courts in both countries ruled that peaceful pro-life vigils near abortion centers are protected expressions of freedom, overturning local bans that had sidelined public prayer and witness for life.
In 2024, Germany imposed a 100-meter buffer zone around abortion facilities, preventing pro-lifers from being able to protest or minister to abortion-minded women.
Court rulings found that this law was discriminatory, and that local pro-life groups did not have a history or harassing or intimidating women.
A similar buffer zone law was also overturned in Austria.
According to reports from Evangelical Focus, Pro Medien Magazin, and Livenet.ch, German authorities in North Rhine-Westphalia imposed a 100-meter buffer zone around abortion facilities in 2024, effectively preventing pro-life organizations from holding gatherings nearby. The state justified the decision under Section 13 of the German Pregnancy Conflict Act, which permits authorities to restrict vigils that “harass or intimidate” pregnant women.
The Aachen Administrative Court, however, ruled that the measure was an erroneous application of the law. Judges found that the pro-life group, which has been active for two decades in promoting life-affirming alternatives to abortion, had been peaceful in its interactions with women entering abortion facilities.
Pregnant women come into contact with the protesters and the images for at most 10 seconds, and can therefore avoid them, the court declared.
The court ruled that German law neither “generally prohibits the expression of opinion nor the confrontation of pregnant women with the opinions of those attending the gathering."
In a similar case in Bavaria, the Bavarian Administrative Court concluded in September 2025 that a 100-meter “no-go zone” does not generally apply to pro-life gatherings around abortion facilities and counseling centers.
Austria’s capital, Vienna, recently saw its administrative court reach a comparable ruling.
The organization Jugend für das Leben (Youth for Life) had intended to organize a “silent and peaceful prayer” dedicated to safeguarding the dignity and sanctity of human life near abortion facilities. Although their initiative was initially reported to the police and subsequently banned, the decision was later overturned following efforts by Alliance Defending Freedom (ADF) International, permitting the event to proceed as planned.
These rulings represent a major setback for pro-abortion campaigners who have pressed European cities to impose “buffer zones” around abortion clinics — areas prohibiting demonstrations, prayer groups, or leaflet distribution.
Similar measures have emerged in the United Kingdom, alleging concerns for “emotional pressure” on women seeking abortions.
European pro-life groups have long posited that buffer zones undermine conscience freedoms while guarding abortion from moral scrutiny. For instance, Christian Concern said:
The UK has a strong heritage of upholding freedom of religion and freedom of expression. But with the implementation of abortion ‘buffer zones’ and the ability of ill-trained council officers to issue FPNs, we are witnessing these freedoms being stripped away as our Christian beliefs and even silent prayer are deemed unnecessary and a ‘risk to the public’.This investigation into buffer zones makes it evident that buffer zones have been weaponised to shut down democratic debate about abortion.As Christians, it is essential we protect our right to speak up for the vulnerable, to defend biblical values and to offer support and life-saving options rather than tolerating the inhumanity of abortion to persist in the UK. The use of Public Spaces Protection Orders and private prosecutions to silence religious beliefs and opposition to abortion is clearly a miscarriage of justice and fundamentally a breach of free speech and freedom of religion.
As many political elites are trying to enshrine abortion as a “right” in European charters, courts are reinforcing that freedom of conscience and religion remain key pillars of European democracies.
For the 40 Days for Life movement — currently active in over 60 countries — these victories reinforce its principle that peaceful presence and intercession can transform hearts without confrontation. The group’s local activities usually entail small gatherings praying peacefully on sidewalks for women, preborn children, and staff of abortion clinics.
