Lawsuit could result in billion-dollar damages for Planned Parenthood

Under the Federal False Claims Act and Texas Medicaid Fraud Prevention Act, the Alliance Defense Fund is representing former Planned Parenthood abortion clinic director Abby Johnson in a lawsuit against the Southeast Texas Planned Parenthood affiliate for submitting “repeated false, fraudulent, and ineligible claims” through the Medicaid Women’s Health Program.

Planned Parenthood allegedly committed over 87,000 false claims between 2007 and 2009 which garnered the organization a reimbursement total of $5.7 million dollars from the WHP in Texas. Each individual fraudulent claim could result an $11,000 fine and therefore may total nearly a billion dollars in damages to the Planned Parenthood affiliate in Texas. Alliance Defense Fund lawyer Michael J. Norton described the potential outcome of the largest Medicaid fraud case in Planned Parenthood’s histroy, Johnson v. Planned Parenthood of Houston and Southeast Texas, as an “all-out war” with Planned Parenthood when they respond to these allegations. “I don’t think it would be unfair to suggest that more [false claims lawsuits] will be coming,” he said.
